What Xavio is and who provides it
Xavio is a business management system (ERP) used through a browser at xavio.ro and through the mobile application of the same name. It is provided by AUTO ȘULEA MOBILE SRL, VAT RO21726236, registered with the Trade Register under J2007000605015, with its registered office at 9D Emil Racoviță Street, Alba Iulia, Alba County, 510175, Romania.
In these terms, we means that company, and you or your company means the legal entity using Xavio together with the people it authorises.
Accounts, the workspace, and who is responsible for users
Each company has its own workspace, with its own accounting, products, documents and users. User accounts are created and administered by the company, not by us: the company decides who gets in, what rights they have, and when access is withdrawn.
One person may have access to several companies. Rights follow the person for each active company, and are evaluated per company, never once for all of them.
What you enter into Xavio stays yours
The invoices, contacts, stock, prices and documents you enter belong to your company. We do not sell them, we do not use them for advertising, and we do not pass them to anyone outside the cases described in the Privacy Policy and in Data processing.
We access them only as far as is necessary to keep the service running, to repair it when it breaks, and to answer your support requests.
What remains your responsibility
The accuracy of the data you enter, the tax and accounting obligations of your company, and keeping your passwords safe. Xavio is the tool with which you produce documents; their content and their declaration to the authorities remain your company's responsibility.
We recommend turning on two-step authentication, available under Settings → Security.
Acceptable use
Do not attempt to reach another company's workspace, do not bypass security measures, do not extract data automatically where you have no right to it, do not upload files containing harmful code, and do not use the service for unlawful activity.
We may suspend an account or a workspace where that is reasonably necessary for security, to stop an abuse, or to comply with the law. We tell you when we are able to.
Invoices, e-Invoicing and reporting to ANAF
Xavio can issue invoices and send them to the Romanian tax authority through SPV, over the connection your company authorises with its own certificate. Transmission, accuracy and deadlines remain obligations of your company; we are responsible for the mechanism working, not for what is declared.
When ANAF rejects a document, their message is shown in the application, on that document.
Availability and backups
We work to keep the service available and fast, but we do not guarantee uninterrupted operation: there can be maintenance windows, failures at our suppliers, and incidents.
The database is backed up automatically every night, locally and off-site, encrypted. A backup is a safety net for incidents, not an archiving service you can call on for any date in the past.
Liability
We are liable for damage we cause intentionally or through gross negligence, and for anything that cannot lawfully be limited. Beyond those cases, our liability is limited to the amount paid for the service for the period in which the problem occurred.
We are not liable for losses arising from data entered incorrectly, from tax obligations that were not met, or from use of the service contrary to these terms.
Duration, termination, and what happens to the data
The contract runs for as long as your company uses the service. On termination, the workspace stays available for export for 30 days and is then deleted, except for data we are required by law to keep — for example the invoices we issued to your company for our own service.
Complete deletion of a workspace can also be started earlier, by the company owner, from Settings → General → Organisation.
Changes, applicable law, contact
We may change these terms. Important changes are announced in the application or here, in the Legal Center, and the date at the top of the page shows the current version.
Romanian law applies, without removing the mandatory protection of the country of residence where that applies. Questions: contact@xavio.ro.
The application is a window onto the same account
The mobile application does not create a separate account and does not hold a separate contract. It is another way into the Xavio account your company gave you, and everything above applies to it unchanged — including the rights your company set for you.
What it can and cannot do today
Today it shows the company dashboard, read-only. It issues nothing, signs nothing and pays nothing, so no document and no legal effect is produced from the phone. Cards and tabs for which you have no right are not drawn at all, rather than shown and then refused.
Store rules
The application is distributed through the App Store and, when it gets there, Google Play. The rules of those stores apply alongside these terms for the download and the update, and the store, not we, handles the download itself.
